Litigation Support

The firm's unique approach to litigation support provides attorneys and their clients with cost effective, time sensitive valuation documentation and expert testimony. As a result of a thorough valuation document, most cases are settled out of court saving a significant amount of money and time litigating the matter. The firm maintains an unparalleled record in its litigation support success. For example, in over 500 tax abatement cases, an average reduction of 25% has been achieved which amounts to over $50 million in total annual tax savings for clients.

The firm also has extensive experience in appraising complex real estate. Brian Underwood has been published on the subject as well as given lectures and seminars; including the New Hampshire Bar Association in conjunction with their Continuing Education Program. Working with leading law firms throughout New England, he has been admitted as an expert witness in superior and federal courts.

Litigation support services include, but are not limited to:

  • Tax abatement
  • Real estate valuation
  • Environmentally impaired property
  • Estate planning & probate
  • Acquisition & disposition disputes
  • Ownership interests / minority ownership
  • Partition Actions
  • Diminution in Value Studies

Mediation

Mediation provides an alternative solution to more costly traditional litigation. Both the New Hampshire Superior Court and the New Hampshire Board of Tax & Land Appeals have rules requiring mediation for most cases that come before them.

Mr. Underwood is the first real estate appraiser to complete the New Hampshire Superior Court's Rule 170 Civil Mediation Training. He has participated in a wide range of mediations both as a participant and as the mediator. With an extensive real estate background, he provides a unique set of tools and skills as a mediator unlike other traditional mediators who may not have a good understanding of the real estate issues involved.
